Ontario’s Legal Framework for Child Custody

Two statutes govern child custody and parenting arrangements in Ontario, and which one applies depends on the parents’ relationship status. The federal Divorce Act covers married spouses pursuing divorce. The provincial Children’s Law Reform Act governs unmarried and common-law parents who separate.

As of March 1, 2021, the Divorce Act replaced “custody” and “access” with “decision-making responsibility” and “parenting time.” The Children’s Law Reform Act uses comparable language. “Child custody” remains the term most people use, and it still accurately describes the subject matter. Knowing the legal terminology matters, though, when you’re reading court documents or any order made after March 2021.

Decision-making responsibility is the legal authority to make major decisions about a child’s upbringing, covering education, health care, religion, and extracurricular activities. Parenting time is the time a child spends in each parent’s care. It is a separate question from who holds decision-making authority. Ontario courts generally have jurisdiction over custody matters when the child is habitually resident in Ontario, as set out in the Children’s Law Reform Act, though jurisdiction can also arise in certain circumstances where the child is physically present in Ontario even if not habitually resident here.

Types of Custody Arrangements in Ontario

Ontario courts don’t apply a single formula to parenting arrangements. Each family’s circumstances are different, and the structure of any arrangement reflects those specifics.

Decision-Making Responsibility

Under sole decision-making responsibility, one parent holds authority over all major decisions about the child’s upbringing. Under joint decision-making responsibility, both parents share that authority, which requires communication and cooperation on significant matters. A less common arrangement, split decision-making responsibility, applies in families with multiple children, where each parent may hold decision-making authority for one or more children. Courts treat these arrangements as highly fact-specific.

Parenting Time Schedules

Parenting time schedules are tailored to each family and can range from primary residence with one parent and scheduled time with the other, to roughly equal time-sharing between homes. Under Ontario’s Child Support Guidelines, shared parenting time is recognized when a child lives with each parent at least 40 percent of the time, which may affect how child support is calculated.

The Best Interests of the Child Standard

Every custody and parenting decision in Ontario is governed by one overriding principle: the best interests of the child. Courts don’t weigh parental preferences against each other. The question is what arrangement best serves the child.

Judges consider a range of factors, including each parent’s ability to meet the child’s physical, emotional, and psychological needs; the strength and history of each parent-child relationship; the child’s own views and preferences where age and maturity allow; the stability the proposed arrangement would provide; and any history of family violence. No single factor controls the outcome. Courts weigh the full picture of each family’s circumstances.

Parents who reach their own agreement on parenting arrangements can do so without court intervention, and courts generally respect that agreement when it serves the child’s best interests. When agreement isn’t possible, mediation, arbitration, or court proceedings are available to resolve the dispute.

How Child Custody Cases Proceed in North York

Family law matters involving custody for North York residents are typically handled at the North York Courthouse. The process usually begins with a legal consultation to assess each parent’s rights and options, followed by negotiation or mediation where both parties are willing.

A negotiated parenting plan can be submitted to the court for approval and, once approved, becomes a legally binding order. When parties can’t reach agreement, a lawyer can file the necessary applications, appear at mandatory case conferences, and represent the client at hearings. Existing orders aren’t permanent. If there has been a material change in circumstances since the original order was made, either parent may apply to have it varied to reflect current realities.
