The Trust Administration Process in Ontario

A trustee generally begins by reviewing the trust deed, which sets out the trust’s terms. This review identifies the trustee’s powers, beneficiary rights, distribution instructions, and investment responsibilities. The precise steps depend on the trust document, its assets, and the beneficiaries’ circumstances.

A trustee administers property held in trust under those terms. This role differs from that of an estate trustee, who manages the deceased person’s estate. In Ontario, an Application for a Certificate of Appointment of Estate Trustee is the court procedure used to confirm a will’s validity and authorize the estate trustee to manage and distribute estate property.

Routine administration commonly requires a trustee to:

  • Identify trust property: Determine which assets belong to the trust rather than to the trustee personally or the deceased person’s estate.
  • Maintain records: Document trust assets, income, expenses, transactions, and distributions separately from personal and estate records.
  • Communicate with beneficiaries: Notify beneficiaries of the trustee’s role and provide appropriate information about the administration.
  • Make authorized distributions: Follow the trust’s instructions concerning amounts, timing, and any conditions or safeguards that apply to a beneficiary.
