How Child Support Is Calculated in Ontario

Ontario child support is determined primarily through the Federal Child Support Guidelines, which set table amounts based on three factors: the payor parent’s gross annual income, province of residence, and number of children. The table amount is the baseline, and courts can only deviate from it in specific circumstances the Guidelines define.

Income determination is straightforward for salaried employees but can get complicated for self-employed individuals, those who operate through a corporation, or parents with investment income. Courts may also impute income to a payor who is voluntarily underemployed or who doesn’t fully disclose their finances. Complete financial disclosure by both parents is required under Ontario family law rules before any guideline calculation can be properly completed.

When a child spends at least 40 percent of their time with each parent, a shared parenting arrangement may apply. In that case, the standard table amount can be adjusted using an offset calculation rather than simply applying the table figure to the higher-earning parent’s income. The result depends on both parents’ incomes and the actual parenting schedule.

Section 7 Special & Extraordinary Expenses

The table amount covers a child’s ordinary day-to-day needs. Section 7 of the Federal Child Support Guidelines addresses additional expenses that go beyond that baseline, shared between parents in proportion to their respective incomes.

Common Section 7 expenses include:

• Childcare costs arising from a parent’s employment, illness, or education
• Health-related expenses not covered by insurance
• Dental and orthodontic costs
• Post-secondary education expenses
• Extracurricular activities necessary given the child’s particular needs or talents

These expenses are added on top of the monthly table amount. They aren’t automatically included and require documentation and agreement, or a court determination, on what qualifies.

Modifying & Enforcing Child Support Orders

Either parent may apply to vary a child support order when a material change in circumstances has occurred. A significant shift in either parent’s income, a change in parenting time, or a child aging out of dependency are all grounds courts recognize. Child support generally continues until the child turns 18 but may extend beyond that if the child is still in secondary school, enrolled in post-secondary education, or has a disability that prevents them from becoming financially independent.

Ontario’s Family Responsibility Office (FRO) automatically registers and enforces court orders and domestic contracts that include child support. When a payor is non-compliant, the FRO can garnish wages, seize tax refunds, and suspend driver’s licences or passports. Parents can opt out of FRO involvement by written agreement, but either party may re-enroll if non-compliance becomes an issue again.
